Interesting Rhode Island law allows Jews to practice incest

According to the Jewish Talmud, marriages between uncles and nieces are considered to be “meritorious”, it is also common knowledge that many of the Rabbis of the Talmud married their own nieces. Yet, what few people in America know is that members of the Jewish community were successful in installing an exception for themselves and themselves only into the Rhode Island marital laws which exempts Jews from any anti-incest laws which conflict with their Talmudic doctrines (i.e. uncle/niece marriage). This law has been on the books since 1764.


TALMUD CONSIDERS UNCLE/NIECE MARRIAGE “MERITORIOUS”

“Concerning him who loves his neighbours, who befriends his relatives, marries his sister’s [50] daughter… FOOTNOTE 50: This is a meritorious act, because the affection a man has for his sister will be extended to her daughter, his wife”. (Babylonian Talmud, Yebamoth 62b)


MANY TALMUDIC RABBIS MARRIED THEIR NIECES 

“On one point, particularly, Roman law differed from Jewish: marriages between an uncle and a niece. We recall that both Rabbi Eliezer and Abba married nieces, as did Rabbi Jose the Galilean … Rabbi Ishmael made a special effort to overrule his vow [not to marry his own niece] and to make the niece more attractive to him by improving her teeth … .” – Baron’s “A Social and Religious History of the Jews”, page 230 (Jewish Publication Society, 1952)

RHODE ISLAND LAW (TITLE 15) – INCEST PROHIBITIONS DO NOT EXTEND TO JEWS

§ 15-1-4 Marriages of kindred allowed by Jewish religion. – The provisions of §§ 15-1-2 and 15-1-3 shall not extend to, or in any way affect, any marriage which shall be solemnized among the Jewish people, within the degrees of affinity or consanguinity allowed by their religion. - http://webserver.rilin.state.ri.us/Statutes/title15/15-1/15-1-4.HTM
